นโยบายคุ้มครองข้อมูลส่วนบุคคลสำหรับลูกค้า คู่สัญญา และบุคคลทั่วไป
บริษัท เอส เทค ซีวิล แอนด์ คอนสตรัคชั่น จำกัด “บริษัท” ตระหนักถึงความสำคัญในความเป็นส่วนตัวและการคุ้มครองข้อมูลส่วนบุคคลของลูกค้า และคู่สัญญาของบริษัท จึงจัดให้มีประกาศนโยบายความเป็นส่วนตัวนี้เพื่อลูกค้าและคู่สัญญาได้รับทราบถึงนโยบายของบริษัทเกี่ยวกับการเก็บรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคลของบุคคลธรรมดาซึ่งเป็นลูกค้าหรือคู่สัญญาของบริษัท รวมเรียกว่า “ท่าน" เพื่อให้เป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ.2562 “พรบ.คุ้มครองข้อมูลส่วนบุคคล” รวมทั้งกฎหมายและกฎเกณฑ์ที่เกี่ยวข้อง โดยประกาศนโยบายความเป็นส่วนตัวนี้จะแจ้งให้ทราบถึงวิธีการที่บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน ประเภทข้อมูล และวัตถุประสงค์ในการดำเนินการดังกล่าว รวมถึงรายละเอียดเกี่ยวกับระยะเวลาในการเก็บรักษาข้อมูล การเปิดเผยข้อมูลส่วนบุคคลให้แก่บุคคลภายนอก สิทธิเกี่ยวกับข้อมูลส่วนบุคคลของท่าน การรักษาความลับและความปลอดภัยของข้อมูลส่วนบุคคล และวิธีการติดต่อกับบริษัท บริษัทจึงขอให้ท่านได้อ่านนโยบายนี้อย่างรอบคอบก่อนเข้าใช้งานเว็ปไซต์ของบริษัท รวมถึงข้อตกลงอื่น ๆ นอกจากนโยบายนี้ที่มีการอ้างถึงในการขอความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล ซึ่งข้อตกลงเหล่านี้จะมีผลผูกพันท่านในทางกฎหมายเมื่อท่านเข้าใช้งานเว็ปไซต์ของบริษัทและเข้าเป็นคู่สัญญากับบริษัท โดยเมื่อท่านได้อ่านนโยบายนี้โดยตลอดแล้วและให้ความยินยอมในการประมวลผลข้อมูลส่วนบุคคลของท่านตามนโยบายนี้แล้ว หากท่านไม่เห็นด้วยที่จะมีการประมวลผลข้อมูลตามนโยบายนี้ ท่านสามารถถอนความยินยอมได้ หากท่านมีข้อสงสัยเกี่ยวกับกับนโยบายนี้ สามารถติดต่อบริษัทได้ตามข้อมูลติดต่อด้านล่าง
ข้อ 1. นโยบายนี้ใช้กับบุคคลดังต่อไปนี้ลูกค้าหรือคู่สัญญาของบริษัท ซึ่งเป็นบุคคลธรรมดา ไม่ว่าจะเป็นลูกค้าหรือคู่สัญญาเดิมและ/หรือลูกค้าหรือคู่สัญญาปัจจุบันของบริษัท และให้หมายความรวมถึง กรรมการ ผู้ถือหุ้น พนักงาน ผู้ค้ำประกัน ผู้ให้หลักประกัน และผู้แทนโดยชอบด้วยกฎหมายของลูกค้าหรือคู่สัญญาซึ่งเป็นองค์กรธุรกิจ และบุคคลธรรมดาอื่นที่มีอำนาจในการกระทำการแทนลูกค้าหรือคู่สัญญาซึ่งเป็นองค์กรธุรกิจนั้น ทั้งนี้ ทางบริษัทขอแนะนำให้ลูกค้าหรือคู่สัญญาซึ่งเป็นองค์กรธุรกิจดำเนินการเพื่อให้มั่นใจว่าบุคคลผู้มีอำนาจกระทำการแทนหรือบุคคลที่เกี่ยวข้องใด ๆ ของท่านได้รับทราบถึงประกาศนโยบายความเป็นส่วนตัวของบริษัท
ข้อ 2. การเก็บรวบรวมข้อมูลส่วนบุคคลบริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลจากท่านโดยตรงซึ่งท่านยินยอมให้บริษัททำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้น โดยจะเก็บรวบรวมข้อมูลส่วนบุคคลเท่าที่จำเป็นภายใต้วัตถุประสงค์อันชอบด้วยกฎหมายของบริษัท และจะไม่เก็บรวบรวมข้อมูลส่วนตัวของท่านจากแหล่งอื่น โดยทั่วไป ข้อมูลส่วนบุคคลของท่านจะไม่มีการนำไปเก็บรวบรวม ใช้ หรือเปิดเผย เว้นแต่เป็นข้อกำหนดหรือบทบัญญัติของกฎหมายที่กำหนดให้ไม่จำเป็นต้องได้รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคลก่อน และบริษัทจะทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคของท่านภายใต้วัตถุประสงค์ที่ได้แจ้งไว้เท่านั้น บริษัทจะไม่ใช้หรือเปิดเผยข้อมูลของท่านที่ทางบริษัทได้เก็บรวบรวมไว้ให้แก่บุคคลหรือหน่วยงานอื่นที่ไม่เกี่ยวข้องตามนโยบายความเป็นส่วนตัวนี้ เว้นแต่ เมื่อได้รับการร้องขอหรือได้รับความยินยอมอย่างชัดแจ้งจากท่าน ข้อมูลส่วนบุคคลของท่าน จะได้รับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลโดยบริษัท ด้วยวิธีการทางอิเล็กทรอนิกส์ และระบบการจัดเก็บเอกสารในรูปของกระดาษ ทั้งนี้ หากท่านไม่ให้ข้อมูลส่วนบุคคลของท่านกับบริษัท อาจส่งผลกระทบต่อท่าน เช่น บริษัทอาจจะไม่สามารถติดต่อท่านเพื่อดำเนินการตามที่ท่านร้องขอได้ ท่านอาจจะไม่ได้รับความสะดวกในการรับบริการจากบริษัท หรือบริษัทอาจจะไม่สามารถปฏิบัติตามสัญญาที่มีต่อท่านได้ ซึ่งอาจจะทำให้ท่านได้รับความเสียหายได้ นอกจากนี้ การที่ท่านไม่ให้ข้อมูลส่วนบุคคลดังกล่าวอาจส่งผลกระทบต่อการปฏิบัติตามกฎหมายใด ๆ ที่บริษัทหรือท่านต้องปฏิบัติตาม และอาจมีบทกำหนดโทษที่เกี่ยวข้อง บริษัทอาจจัดเก็บบันทึกข้อมูลการเข้าออกเว็บไซต์ (Log Files) ของท่าน โดยจะจัดเก็บข้อมูลดังนี้ หมายเลขไอพี (IP Address) หรือ เวลาการเข้าใช้งาน เป็นต้น เว็บไซต์ของบริษัท อาจใช้คุกกี้ในบางกรณี คุกกี้ คือไฟล์ข้อมูลขนาดเล็กที่จัดเก็บข้อมูลซึ่งแลกเปลี่ยนระหว่างคอมพิวเตอร์ของท่านและเว็บไซต์ของบริษัท บริษัทใช้คุกกี้เฉพาะเพื่อการจัดเก็บข้อมูลที่อาจเป็นประโยชน์ต่อท่านในครั้งถัดไปที่ท่านกลับมาเยี่ยมชมเว็บไซต์ของบริษัท เมื่อท่านเข้าใช้บริการเว็บบราวเซอร์ ท่านสามารถตั้งค่าเพื่อยอมรับคุกกี้ทั้งหมดหรือปฏิเสธคุกกี้ทั้งหมด หรือแจ้งเตือนให้ท่านทราบเมื่อมีการส่งคุกกี้ โดยท่านสามารถเข้าไปตั้งค่าที่เมนู “ความช่วยเหลือ” ในบราวเซอร์ของท่านเพื่อเรียนรู้วิธีการเปลี่ยนแปลงการใช้คุกกี้ของท่านได้ โปรดทราบว่าการปิดการใช้งานคุกกี้อาจส่งผลต่อการใช้งานบางบริการของท่านได้
ข้อ 3. วัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล3.1 เพื่อใช้สำหรับการลงทะเบียนและการยืนยันตัวตนของท่าน เช่น ในการลงทะเบียนเข้าสู่เว็ปไซต์ของบริษัท หรือแอปพลิเคชั่นซึ่งผ่านบัญชีผู้ใช้งานของบริษัท หรือยืนยันตัวตนในการติดต่อซื้อขายสินค้าและรับบริการต่าง ๆ จากบริษัท การนำเสนอข้อมูลผลิตภัณฑ์ของบริษัท และบริษัทในเครือ
3.2 การจัดการด้านการดำเนินธุรกิจ การอำนวยความสะดวก การพัฒนาธุรกิจของบริษัทและบริษัทที่มีความเกี่ยวข้องกัน เช่น การค้นหาและแนะนำผลิตภัณฑ์และบริการที่เหมาะสมแก่ท่าน การบริการหลังการขาย การประเมินหรือวิจัยการตลาด เพื่อพัฒนาปรับปรุงผลิตภัณฑ์ ของบริษัท และบริษัทในเครือ
3.3 การปกป้องและป้องกันสิทธิและผลประโยชน์ของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน ที่เกี่ยวข้องกับการดำเนินการทางปกครอง กระบวนการยุติธรรมของศาล และรวมถึงการไกล่เกลี่ยประนีประนอมข้อพิพาททั้งปวง
3.4 เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน เช่น มาตราการรักษาความปลอดภัยของบริษัท การบริหารความเสี่ยง การสนับสนุนด้านการนำระบบเทคโนโลยีสารสนเทศ และการนำข้อมูลไปใช้และการบำรุงรักษาระบบด้านเทคโนโลยีสารสนเทศ การตรวจสอบระบบต่าง ๆ เพื่อป้องกันการใช้งานที่ผิดกฎหมาย หรือขัดต่อนโยบายของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน การตรวจสอบและป้องกันการคุกคามใด ๆ ที่มิชอบด้วยกฎหมาย
3.5 เป็นการจำเป็นเพื่อสงวน หรือปกป้องสิทธิของบริษัทหรือบริษัทที่เกี่ยวข้องกันภายใต้อำนาจศาล เพื่อตอบรับคำร้องขอด้านการบังคับใช้กฎหมายหรือกระบวนการการเปิดเผยข้อมูล หรือในกรณีที่จำเป็นหรือมีสิทธิกระทำได้ตามกฎหมายที่มีผลบังคับใช้ คำสั่งศาล ระเบียบของราชการ
3.6 เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญา หรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา
3.7 เป็นการปฏิบัติตามบทบัญญัติของกฎหมายที่บังคับต่อบริษัทที่ต้องใช้ข้อมูลส่วนบุคคลของท่าน เช่น กฎหมายภาษีอากร กฎหมายหลักทรัพย์และตลาดหลักทรัพย์ กฎหมายคอมพิวเตอร์ กฎหมายล้มละลาย เป็นต้น และรวมถึงการปฏิบัติตามข้อบังคับ ข้อกำหนดตามกฎหมายหรือของหน่วยงานราชการกำหนดทั้งก่อน ขณะหรือภายหลังจากที่ประกาศฉบับนี้มีผลบังคับใช้
อนึ่ง บริษัท อาจเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลของท่านได้โดยไม่ต้องได้รับความยินยอมจากท่าน ทั้งนี้เท่าที่จำเป็นและตราบเท่าที่เป็นไปตามวัตถุประสงค์และในกรณีดังต่อไปนี้เท่านั้น
(ก) เพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวกับการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุเพื่อประโยชน์สาธารณะ หรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการป้องกันที่เหมาะสมเพื่อคุ้มครองสิทธิและเสรีภาพของท่าน
(ข) เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล
(ค) เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญาหรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญานั้น
(ง) เป็นการจำเป็นเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้มอบให้แก่บริษัท
(จ) เป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่บริษัท เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญน้อยกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของท่าน
(ฉ) เป็นการปฏิบัติตามกฎหมายของบริษัท
ข้อ 4. ข้อมูลส่วนบุคคลของท่านที่บริษัทจะทำการเก็บรวมรวม ได้แก่4.1 ชื่อ – นามสกุล วันเกิด อายุ
4.2 ลายมือชื่อ
4.3 ที่อยู่ตามภูมิลำเนาหรือที่อยู่ปัจจุบัน
4.4 หมายเลขโทรศัพท์
4.5 อีเมล์แอดเดรส
4.6 สำเนาบัตรประจำตัวประชาชน
4.7 สำเนาใบอนุญาตต่าง ๆ ที่ปรากฏข้อมูลส่วนบุคคล
4.8 หมายเลขบัญชีธนาคาร
ข้อ 5. ระยะเวลาในการเก็บรวบรวมข้อมูลส่วนบุคคลบริษัทมีความจำเป็นที่จะต้องเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นในระหว่างที่ท่านยังมีความสัมพันธ์อยู่กับบริษัท หรือตลอดระยะเวลาเท่าที่จำเป็นเพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวข้องกับการให้บริการของบริษัท หรือตลอดระยะเวลาที่บริษัทกับท่านยังมีนิติสัมพันธ์กันตามกฎหมายหรือตามสัญญา และจะเก็บรวบรวมไว้ต่อไปภายหลังจากนั้นเพื่อวัตถุประสงค์ในการพิสูจน์ตรวจสอบกรณีอาจเกิดข้อพิพาทภายในอายุความตามที่กฎหมายกำหนดไว้สูงสุดเป็นระยะเวลาไม่เกิน 10 ปี หากไม่มีข้อพิพาทใด ๆ เกิดขึ้น หรือจนกว่าคดีจะถึงที่สุดและครบกำหนดอายุความในการบังคับคดี กรณีมีข้อพิพาทเกิดขึ้น ทั้งนี้ บริษัทจะลบหรือทำลายข้อมูลส่วนบุคคล หรือทำให้เป็นข้อมูลที่ไม่สามารถระบุถึงตัวตนของท่านได้เมื่อหมดความจำเป็นหรือสิ้นสุดระยะเวลาดังกล่าว
ข้อ 6. ประเภทของบุคคลหรือหน่วยงานซึ่งข้อมูลส่วนบุคคลของท่านอาจจะถูกเปิดเผย ได้แก่6.1 บริษัทที่มีความเกี่ยวข้องกัน บริษัทในเครือ พันธมิตรทางธุรกิจ และ/หรือ บุคคลอื่นใดที่เกี่ยวข้องกับบริษัท รวมถึง กรรมการ ผู้บริหาร พนักงาน ลูกจ้าง ผู้รับจ้าง ตัวแทน ที่ปรึกษาของบริษัท และ/หรือของบุคคลดังกล่าว
6.2 คู่ค้า ตัวแทน องค์กรหรือหน่วยงานภาครัฐหรือรัฐวิสาหกิจที่บริษัทเป็นคู่สัญญา หรือมีนิติสัมพันธ์ (เช่น องค์กรตรวจสอบทั้งภายในและภายนอกบริษัท ผู้สอบบัญชี ธนาคาร เป็นต้น) ซึ่งการเปิดเผยข้อมูลส่วนบุคคลของท่านจะมีวัตถุประสงค์โดยเฉพาะเจาะจง ภายใต้ฐานทางกฎหมายและมาตรการความปลอดภัยที่เหมาะสม
6.3 ตัวแทนทวงถามหนี้ ทนายความ ศาล หน่วยงานภาครัฐ หรือบุคคลใด ๆ ที่บริษัทถูกกำหนดหรือได้รับอนุญาตให้เปิดเผยข้อมูลส่วนบุคคลตามกฎหมาย กฎระเบียบ หรือคำสั่ง
ข้อ 7. สิทธิในข้อมูลส่วนบุคคลของท่าน มีดังนี้7.1 สิทธิในการถอนความยินยอมเสียเมื่อใดก็ได้ เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอมโดยกฎหมายหรือสัญญาที่ให้ประโยชน์แก่ท่าน ทั้งนี้ การถอนความยินยอมดังกล่าวย่อมไม่กระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วโดยชอบก่อนที่จะถอนความยินยอม
7.2 สิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลที่เกี่ยวกับท่านซึ่งอยู่ในความรับผิดชอบของบริษัท หรือขอให้เปิดเผยถึงการได้มาซึ่งข้อมูลส่วนบุคคลที่ท่านไม่ได้ให้ความยินยอม เว้นแต่ ในกรณีที่มีกฎหมายหรือคำสั่งศาลห้ามมิให้กระทำการเช่นนั้น หรือหากการเข้าถึงหรือขอรับสำเนาข้อมูลของท่านจะส่งผลกระทบที่อาจก่อให้เกิดความเสียหายต่อสิทธิและเสรีภาพของบุคคลอื่น
7.3 สิทธิขอรับข้อมูลส่วนบุคคลที่เกี่ยวกับท่านในรูปแบบอัตโนมัติได้ในกรณีที่บริษัทได้เก็บรวบรวมข้อมูลของท่านไว้ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติ และสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ รวมทั้งมีสิทธิ
7.3.1 ขอให้บริษัทส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังบุคคลหรือนิติบุคคลอื่นเมื่อสามารถทำได้ด้วยวิธีการอัตโนมัติ
7.3.2 ขอรับข้อมูลส่วนบุคคลที่บริษัทได้ส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังบุคคลหรือนิติบุคคลอื่นโดยตรง เว้นแต่โดยสภาพทางเทคนิคไม่สามารถทำได้
7.4 สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่เกี่ยวกับท่านเมื่อใดก็ได้ ดังต่อไปนี้
7.4.1 เมื่อมีการเก็บรวบรวมข้อมูลส่วนบุคคลเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้รับมอบให้แก่บริษัท โดยไม่ได้รับความยินยอมจากท่านในการเก็บรวบรวมข้อมูล
7.4.2 เมื่อมีการเก็บรวบรวมข้อมูลส่วนบุคคลเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือของบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่บริษัท โดยไม่ได้รับความยินยอมจากท่านในการเก็บรวบรวมข้อมูล
7.4.3 เมื่อมีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
7.4.4 เมื่อมีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสต์ ประวัติศาสตร์ หรือสถิติ เว้นแต่เป็นการจำเป็นเพื่อการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท
7.5 สิทธิในการขอให้ดำเนินการลบหรือทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ ในกรณีดังต่อไปนี้ 7.5.1 เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล 7.5.2 เมื่อท่านถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่มีอำนาจตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้นได้ต่อไป 7.5.3 เมื่อท่านคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลตามข้อ 7.4
7.6 สิทธิในการขอให้บริษัทดำเนินการให้ข้อมูลส่วนบุคคลของท่านนั้นถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด
7.7 สิทธิในการขอให้ระงับการใช้ข้อมูลส่วนบุคคลได้ ในกรณีดังต่อไปนี้
7.7.1 เมื่ออยู่ในระหว่างการตรวจสอบตามที่ท่านร้องขอให้ดำเนินการตามข้อ 7.6
7.7.2 เมื่อเป็นข้อมูลส่วนบุคคลที่ต้องลบหรือทำลายตามข้อ 7.5 แต่ท่านได้ขอให้ระงับการใช้แทน

ข้อ 1. นโยบายนี้ใช้กับบุคคลดังต่อไปนี้ลูกค้าหรือคู่สัญญาของบริษัท ซึ่งเป็นบุคคลธรรมดา ไม่ว่าจะเป็นลูกค้าหรือคู่สัญญาเดิมและ/หรือลูกค้าหรือคู่สัญญาปัจจุบันของบริษัท และให้หมายความรวมถึง กรรมการ ผู้ถือหุ้น พนักงาน ผู้ค้ำประกัน ผู้ให้หลักประกัน และผู้แทนโดยชอบด้วยกฎหมายของลูกค้าหรือคู่สัญญาซึ่งเป็นองค์กรธุรกิจ และบุคคลธรรมดาอื่นที่มีอำนาจในการกระทำการแทนลูกค้าหรือคู่สัญญาซึ่งเป็นองค์กรธุรกิจนั้น ทั้งนี้ ทางบริษัทขอแนะนำให้ลูกค้าหรือคู่สัญญาซึ่งเป็นองค์กรธุรกิจดำเนินการเพื่อให้มั่นใจว่าบุคคลผู้มีอำนาจกระทำการแทนหรือบุคคลที่เกี่ยวข้องใด ๆ ของท่านได้รับทราบถึงประกาศนโยบายความเป็นส่วนตัวของบริษัท
ข้อ 2. การเก็บรวบรวมข้อมูลส่วนบุคคลบริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลจากท่านโดยตรงซึ่งท่านยินยอมให้บริษัททำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้น โดยจะเก็บรวบรวมข้อมูลส่วนบุคคลเท่าที่จำเป็นภายใต้วัตถุประสงค์อันชอบด้วยกฎหมายของบริษัท และจะไม่เก็บรวบรวมข้อมูลส่วนตัวของท่านจากแหล่งอื่น โดยทั่วไป ข้อมูลส่วนบุคคลของท่านจะไม่มีการนำไปเก็บรวบรวม ใช้ หรือเปิดเผย เว้นแต่เป็นข้อกำหนดหรือบทบัญญัติของกฎหมายที่กำหนดให้ไม่จำเป็นต้องได้รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคลก่อน และบริษัทจะทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคของท่านภายใต้วัตถุประสงค์ที่ได้แจ้งไว้เท่านั้น บริษัทจะไม่ใช้หรือเปิดเผยข้อมูลของท่านที่ทางบริษัทได้เก็บรวบรวมไว้ให้แก่บุคคลหรือหน่วยงานอื่นที่ไม่เกี่ยวข้องตามนโยบายความเป็นส่วนตัวนี้ เว้นแต่ เมื่อได้รับการร้องขอหรือได้รับความยินยอมอย่างชัดแจ้งจากท่าน ข้อมูลส่วนบุคคลของท่าน จะได้รับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลโดยบริษัท ด้วยวิธีการทางอิเล็กทรอนิกส์ และระบบการจัดเก็บเอกสารในรูปของกระดาษ ทั้งนี้ หากท่านไม่ให้ข้อมูลส่วนบุคคลของท่านกับบริษัท อาจส่งผลกระทบต่อท่าน เช่น บริษัทอาจจะไม่สามารถติดต่อท่านเพื่อดำเนินการตามที่ท่านร้องขอได้ ท่านอาจจะไม่ได้รับความสะดวกในการรับบริการจากบริษัท หรือบริษัทอาจจะไม่สามารถปฏิบัติตามสัญญาที่มีต่อท่านได้ ซึ่งอาจจะทำให้ท่านได้รับความเสียหายได้ นอกจากนี้ การที่ท่านไม่ให้ข้อมูลส่วนบุคคลดังกล่าวอาจส่งผลกระทบต่อการปฏิบัติตามกฎหมายใด ๆ ที่บริษัทหรือท่านต้องปฏิบัติตาม และอาจมีบทกำหนดโทษที่เกี่ยวข้อง บริษัทอาจจัดเก็บบันทึกข้อมูลการเข้าออกเว็บไซต์ (Log Files) ของท่าน โดยจะจัดเก็บข้อมูลดังนี้ หมายเลขไอพี (IP Address) หรือ เวลาการเข้าใช้งาน เป็นต้น เว็บไซต์ของบริษัท อาจใช้คุกกี้ในบางกรณี คุกกี้ คือไฟล์ข้อมูลขนาดเล็กที่จัดเก็บข้อมูลซึ่งแลกเปลี่ยนระหว่างคอมพิวเตอร์ของท่านและเว็บไซต์ของบริษัท บริษัทใช้คุกกี้เฉพาะเพื่อการจัดเก็บข้อมูลที่อาจเป็นประโยชน์ต่อท่านในครั้งถัดไปที่ท่านกลับมาเยี่ยมชมเว็บไซต์ของบริษัท เมื่อท่านเข้าใช้บริการเว็บบราวเซอร์ ท่านสามารถตั้งค่าเพื่อยอมรับคุกกี้ทั้งหมดหรือปฏิเสธคุกกี้ทั้งหมด หรือแจ้งเตือนให้ท่านทราบเมื่อมีการส่งคุกกี้ โดยท่านสามารถเข้าไปตั้งค่าที่เมนู “ความช่วยเหลือ” ในบราวเซอร์ของท่านเพื่อเรียนรู้วิธีการเปลี่ยนแปลงการใช้คุกกี้ของท่านได้ โปรดทราบว่าการปิดการใช้งานคุกกี้อาจส่งผลต่อการใช้งานบางบริการของท่านได้
ข้อ 3. วัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล3.1 เพื่อใช้สำหรับการลงทะเบียนและการยืนยันตัวตนของท่าน เช่น ในการลงทะเบียนเข้าสู่เว็ปไซต์ของบริษัท หรือแอปพลิเคชั่นซึ่งผ่านบัญชีผู้ใช้งานของบริษัท หรือยืนยันตัวตนในการติดต่อซื้อขายสินค้าและรับบริการต่าง ๆ จากบริษัท การนำเสนอข้อมูลผลิตภัณฑ์ของบริษัท และบริษัทในเครือ
3.2 การจัดการด้านการดำเนินธุรกิจ การอำนวยความสะดวก การพัฒนาธุรกิจของบริษัทและบริษัทที่มีความเกี่ยวข้องกัน เช่น การค้นหาและแนะนำผลิตภัณฑ์และบริการที่เหมาะสมแก่ท่าน การบริการหลังการขาย การประเมินหรือวิจัยการตลาด เพื่อพัฒนาปรับปรุงผลิตภัณฑ์ ของบริษัท และบริษัทในเครือ
3.3 การปกป้องและป้องกันสิทธิและผลประโยชน์ของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน ที่เกี่ยวข้องกับการดำเนินการทางปกครอง กระบวนการยุติธรรมของศาล และรวมถึงการไกล่เกลี่ยประนีประนอมข้อพิพาททั้งปวง
3.4 เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน เช่น มาตราการรักษาความปลอดภัยของบริษัท การบริหารความเสี่ยง การสนับสนุนด้านการนำระบบเทคโนโลยีสารสนเทศ และการนำข้อมูลไปใช้และการบำรุงรักษาระบบด้านเทคโนโลยีสารสนเทศ การตรวจสอบระบบต่าง ๆ เพื่อป้องกันการใช้งานที่ผิดกฎหมาย หรือขัดต่อนโยบายของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน การตรวจสอบและป้องกันการคุกคามใด ๆ ที่มิชอบด้วยกฎหมาย
3.5 เป็นการจำเป็นเพื่อสงวน หรือปกป้องสิทธิของบริษัทหรือบริษัทที่เกี่ยวข้องกันภายใต้อำนาจศาล เพื่อตอบรับคำร้องขอด้านการบังคับใช้กฎหมายหรือกระบวนการการเปิดเผยข้อมูล หรือในกรณีที่จำเป็นหรือมีสิทธิกระทำได้ตามกฎหมายที่มีผลบังคับใช้ คำสั่งศาล ระเบียบของราชการ
3.6 เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญา หรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา
3.7 เป็นการปฏิบัติตามบทบัญญัติของกฎหมายที่บังคับต่อบริษัทที่ต้องใช้ข้อมูลส่วนบุคคลของท่าน เช่น กฎหมายภาษีอากร กฎหมายหลักทรัพย์และตลาดหลักทรัพย์ กฎหมายคอมพิวเตอร์ กฎหมายล้มละลาย เป็นต้น และรวมถึงการปฏิบัติตามข้อบังคับ ข้อกำหนดตามกฎหมายหรือของหน่วยงานราชการกำหนดทั้งก่อน ขณะหรือภายหลังจากที่ประกาศฉบับนี้มีผลบังคับใช้
อนึ่ง บริษัท อาจเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลของท่านได้โดยไม่ต้องได้รับความยินยอมจากท่าน ทั้งนี้เท่าที่จำเป็นและตราบเท่าที่เป็นไปตามวัตถุประสงค์และในกรณีดังต่อไปนี้เท่านั้น
(ก) เพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวกับการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุเพื่อประโยชน์สาธารณะ หรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการป้องกันที่เหมาะสมเพื่อคุ้มครองสิทธิและเสรีภาพของท่าน
(ข) เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล
(ค) เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญาหรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญานั้น
(ง) เป็นการจำเป็นเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้มอบให้แก่บริษัท
(จ) เป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่บริษัท เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญน้อยกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของท่าน
(ฉ) เป็นการปฏิบัติตามกฎหมายของบริษัท
ข้อ 4. ข้อมูลส่วนบุคคลของท่านที่บริษัทจะทำการเก็บรวมรวม ได้แก่4.1 ชื่อ – นามสกุล วันเกิด อายุ
4.2 ลายมือชื่อ
4.3 ที่อยู่ตามภูมิลำเนาหรือที่อยู่ปัจจุบัน
4.4 หมายเลขโทรศัพท์
4.5 อีเมล์แอดเดรส
4.6 สำเนาบัตรประจำตัวประชาชน
4.7 สำเนาใบอนุญาตต่าง ๆ ที่ปรากฏข้อมูลส่วนบุคคล
4.8 หมายเลขบัญชีธนาคาร
ข้อ 5. ระยะเวลาในการเก็บรวบรวมข้อมูลส่วนบุคคลบริษัทมีความจำเป็นที่จะต้องเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นในระหว่างที่ท่านยังมีความสัมพันธ์อยู่กับบริษัท หรือตลอดระยะเวลาเท่าที่จำเป็นเพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวข้องกับการให้บริการของบริษัท หรือตลอดระยะเวลาที่บริษัทกับท่านยังมีนิติสัมพันธ์กันตามกฎหมายหรือตามสัญญา และจะเก็บรวบรวมไว้ต่อไปภายหลังจากนั้นเพื่อวัตถุประสงค์ในการพิสูจน์ตรวจสอบกรณีอาจเกิดข้อพิพาทภายในอายุความตามที่กฎหมายกำหนดไว้สูงสุดเป็นระยะเวลาไม่เกิน 10 ปี หากไม่มีข้อพิพาทใด ๆ เกิดขึ้น หรือจนกว่าคดีจะถึงที่สุดและครบกำหนดอายุความในการบังคับคดี กรณีมีข้อพิพาทเกิดขึ้น ทั้งนี้ บริษัทจะลบหรือทำลายข้อมูลส่วนบุคคล หรือทำให้เป็นข้อมูลที่ไม่สามารถระบุถึงตัวตนของท่านได้เมื่อหมดความจำเป็นหรือสิ้นสุดระยะเวลาดังกล่าว
ข้อ 6. ประเภทของบุคคลหรือหน่วยงานซึ่งข้อมูลส่วนบุคคลของท่านอาจจะถูกเปิดเผย ได้แก่6.1 บริษัทที่มีความเกี่ยวข้องกัน บริษัทในเครือ พันธมิตรทางธุรกิจ และ/หรือ บุคคลอื่นใดที่เกี่ยวข้องกับบริษัท รวมถึง กรรมการ ผู้บริหาร พนักงาน ลูกจ้าง ผู้รับจ้าง ตัวแทน ที่ปรึกษาของบริษัท และ/หรือของบุคคลดังกล่าว
6.2 คู่ค้า ตัวแทน องค์กรหรือหน่วยงานภาครัฐหรือรัฐวิสาหกิจที่บริษัทเป็นคู่สัญญา หรือมีนิติสัมพันธ์ (เช่น องค์กรตรวจสอบทั้งภายในและภายนอกบริษัท ผู้สอบบัญชี ธนาคาร เป็นต้น) ซึ่งการเปิดเผยข้อมูลส่วนบุคคลของท่านจะมีวัตถุประสงค์โดยเฉพาะเจาะจง ภายใต้ฐานทางกฎหมายและมาตรการความปลอดภัยที่เหมาะสม
6.3 ตัวแทนทวงถามหนี้ ทนายความ ศาล หน่วยงานภาครัฐ หรือบุคคลใด ๆ ที่บริษัทถูกกำหนดหรือได้รับอนุญาตให้เปิดเผยข้อมูลส่วนบุคคลตามกฎหมาย กฎระเบียบ หรือคำสั่ง
ข้อ 7. สิทธิในข้อมูลส่วนบุคคลของท่าน มีดังนี้7.1 สิทธิในการถอนความยินยอมเสียเมื่อใดก็ได้ เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอมโดยกฎหมายหรือสัญญาที่ให้ประโยชน์แก่ท่าน ทั้งนี้ การถอนความยินยอมดังกล่าวย่อมไม่กระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วโดยชอบก่อนที่จะถอนความยินยอม
7.2 สิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลที่เกี่ยวกับท่านซึ่งอยู่ในความรับผิดชอบของบริษัท หรือขอให้เปิดเผยถึงการได้มาซึ่งข้อมูลส่วนบุคคลที่ท่านไม่ได้ให้ความยินยอม เว้นแต่ ในกรณีที่มีกฎหมายหรือคำสั่งศาลห้ามมิให้กระทำการเช่นนั้น หรือหากการเข้าถึงหรือขอรับสำเนาข้อมูลของท่านจะส่งผลกระทบที่อาจก่อให้เกิดความเสียหายต่อสิทธิและเสรีภาพของบุคคลอื่น
7.3 สิทธิขอรับข้อมูลส่วนบุคคลที่เกี่ยวกับท่านในรูปแบบอัตโนมัติได้ในกรณีที่บริษัทได้เก็บรวบรวมข้อมูลของท่านไว้ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติ และสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ รวมทั้งมีสิทธิ
7.3.1 ขอให้บริษัทส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังบุคคลหรือนิติบุคคลอื่นเมื่อสามารถทำได้ด้วยวิธีการอัตโนมัติ
7.3.2 ขอรับข้อมูลส่วนบุคคลที่บริษัทได้ส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังบุคคลหรือนิติบุคคลอื่นโดยตรง เว้นแต่โดยสภาพทางเทคนิคไม่สามารถทำได้
7.4 สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่เกี่ยวกับท่านเมื่อใดก็ได้ ดังต่อไปนี้
7.4.1 เมื่อมีการเก็บรวบรวมข้อมูลส่วนบุคคลเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้รับมอบให้แก่บริษัท โดยไม่ได้รับความยินยอมจากท่านในการเก็บรวบรวมข้อมูล
7.4.2 เมื่อมีการเก็บรวบรวมข้อมูลส่วนบุคคลเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือของบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่บริษัท โดยไม่ได้รับความยินยอมจากท่านในการเก็บรวบรวมข้อมูล
7.4.3 เมื่อมีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
7.4.4 เมื่อมีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสต์ ประวัติศาสตร์ หรือสถิติ เว้นแต่เป็นการจำเป็นเพื่อการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท
7.5 สิทธิในการขอให้ดำเนินการลบหรือทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ ในกรณีดังต่อไปนี้ 7.5.1 เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล 7.5.2 เมื่อท่านถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่มีอำนาจตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้นได้ต่อไป 7.5.3 เมื่อท่านคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลตามข้อ 7.4
7.6 สิทธิในการขอให้บริษัทดำเนินการให้ข้อมูลส่วนบุคคลของท่านนั้นถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด
7.7 สิทธิในการขอให้ระงับการใช้ข้อมูลส่วนบุคคลได้ ในกรณีดังต่อไปนี้
7.7.1 เมื่ออยู่ในระหว่างการตรวจสอบตามที่ท่านร้องขอให้ดำเนินการตามข้อ 7.6
7.7.2 เมื่อเป็นข้อมูลส่วนบุคคลที่ต้องลบหรือทำลายตามข้อ 7.5 แต่ท่านได้ขอให้ระงับการใช้แทน
7.7.3 เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล แต่เจ้าของข้อมูลส่วนบุคคลมีความจำเป็นต้องขอให้เก็บรักษาไว้เพื่อใช้ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมายหรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย
7.7.4 เมื่อบริษัทอยู่ในระหว่างการพิสูจน์กรณีที่ท่านมีคำขอคัดค้านตามข้อ 7.4 แต่บริษัทได้ปฏิเสธคำคัดค้านของท่านดังกล่าว
7.8 สิทธิในการร้องเรียนในกรณีที่บริษัทหรือผู้ที่เกี่ยวข้องกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล รวมทั้งลูกจ้างหรือผู้รับจ้างของบริษัทหรือของผู้ที่เกี่ยวข้องกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลฝ่าฝืนหรือไม่ปฏิบัติตามพรบ.คุ้มครองข้อมูลส่วนบุคคลหรือประกาศที่ออกตามพรบ.ดังกล่าว หากท่านต้องการใช้สิทธิใด ๆ ที่ระบุในส่วนนี้ ท่านสามารถติดต่อบริษัทได้โดยใช้วิธีการที่อยู่ในส่วน “วิธีการติดต่อบริษัท” คำร้องขอใช้สิทธิใด ๆ ข้างต้นอาจถูกจำกัดโดยกฎหมายที่เกี่ยวข้อง อาจมีบางกรณีที่บริษัทสามารถปฏิเสธคำขอของท่านได้โดยสมควรและโดยชอบ เช่น เมื่อบริษัทต้องปฏิบัติตามกฎหมายหรือคำสั่งศาล หรือที่กฎหมายให้อำนาจที่จะกระทำได้

ข้อ 2. การเก็บรวบรวมข้อมูลส่วนบุคคลบริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลจากท่านโดยตรงซึ่งท่านยินยอมให้บริษัททำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้น โดยจะเก็บรวบรวมข้อมูลส่วนบุคคลเท่าที่จำเป็นภายใต้วัตถุประสงค์อันชอบด้วยกฎหมายของบริษัท และจะไม่เก็บรวบรวมข้อมูลส่วนตัวของท่านจากแหล่งอื่น โดยทั่วไป ข้อมูลส่วนบุคคลของท่านจะไม่มีการนำไปเก็บรวบรวม ใช้ หรือเปิดเผย เว้นแต่เป็นข้อกำหนดหรือบทบัญญัติของกฎหมายที่กำหนดให้ไม่จำเป็นต้องได้รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคลก่อน และบริษัทจะทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคของท่านภายใต้วัตถุประสงค์ที่ได้แจ้งไว้เท่านั้น บริษัทจะไม่ใช้หรือเปิดเผยข้อมูลของท่านที่ทางบริษัทได้เก็บรวบรวมไว้ให้แก่บุคคลหรือหน่วยงานอื่นที่ไม่เกี่ยวข้องตามนโยบายความเป็นส่วนตัวนี้ เว้นแต่ เมื่อได้รับการร้องขอหรือได้รับความยินยอมอย่างชัดแจ้งจากท่าน ข้อมูลส่วนบุคคลของท่าน จะได้รับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลโดยบริษัท ด้วยวิธีการทางอิเล็กทรอนิกส์ และระบบการจัดเก็บเอกสารในรูปของกระดาษ ทั้งนี้ หากท่านไม่ให้ข้อมูลส่วนบุคคลของท่านกับบริษัท อาจส่งผลกระทบต่อท่าน เช่น บริษัทอาจจะไม่สามารถติดต่อท่านเพื่อดำเนินการตามที่ท่านร้องขอได้ ท่านอาจจะไม่ได้รับความสะดวกในการรับบริการจากบริษัท หรือบริษัทอาจจะไม่สามารถปฏิบัติตามสัญญาที่มีต่อท่านได้ ซึ่งอาจจะทำให้ท่านได้รับความเสียหายได้ นอกจากนี้ การที่ท่านไม่ให้ข้อมูลส่วนบุคคลดังกล่าวอาจส่งผลกระทบต่อการปฏิบัติตามกฎหมายใด ๆ ที่บริษัทหรือท่านต้องปฏิบัติตาม และอาจมีบทกำหนดโทษที่เกี่ยวข้อง บริษัทอาจจัดเก็บบันทึกข้อมูลการเข้าออกเว็บไซต์ (Log Files) ของท่าน โดยจะจัดเก็บข้อมูลดังนี้ หมายเลขไอพี (IP Address) หรือ เวลาการเข้าใช้งาน เป็นต้น เว็บไซต์ของบริษัท อาจใช้คุกกี้ในบางกรณี คุกกี้ คือไฟล์ข้อมูลขนาดเล็กที่จัดเก็บข้อมูลซึ่งแลกเปลี่ยนระหว่างคอมพิวเตอร์ของท่านและเว็บไซต์ของบริษัท บริษัทใช้คุกกี้เฉพาะเพื่อการจัดเก็บข้อมูลที่อาจเป็นประโยชน์ต่อท่านในครั้งถัดไปที่ท่านกลับมาเยี่ยมชมเว็บไซต์ของบริษัท เมื่อท่านเข้าใช้บริการเว็บบราวเซอร์ ท่านสามารถตั้งค่าเพื่อยอมรับคุกกี้ทั้งหมดหรือปฏิเสธคุกกี้ทั้งหมด หรือแจ้งเตือนให้ท่านทราบเมื่อมีการส่งคุกกี้ โดยท่านสามารถเข้าไปตั้งค่าที่เมนู “ความช่วยเหลือ” ในบราวเซอร์ของท่านเพื่อเรียนรู้วิธีการเปลี่ยนแปลงการใช้คุกกี้ของท่านได้ โปรดทราบว่าการปิดการใช้งานคุกกี้อาจส่งผลต่อการใช้งานบางบริการของท่านได้
ข้อ 3. วัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล3.1 เพื่อใช้สำหรับการลงทะเบียนและการยืนยันตัวตนของท่าน เช่น ในการลงทะเบียนเข้าสู่เว็ปไซต์ของบริษัท หรือแอปพลิเคชั่นซึ่งผ่านบัญชีผู้ใช้งานของบริษัท หรือยืนยันตัวตนในการติดต่อซื้อขายสินค้าและรับบริการต่าง ๆ จากบริษัท การนำเสนอข้อมูลผลิตภัณฑ์ของบริษัท และบริษัทในเครือ
3.2 การจัดการด้านการดำเนินธุรกิจ การอำนวยความสะดวก การพัฒนาธุรกิจของบริษัทและบริษัทที่มีความเกี่ยวข้องกัน เช่น การค้นหาและแนะนำผลิตภัณฑ์และบริการที่เหมาะสมแก่ท่าน การบริการหลังการขาย การประเมินหรือวิจัยการตลาด เพื่อพัฒนาปรับปรุงผลิตภัณฑ์ ของบริษัท และบริษัทในเครือ
3.3 การปกป้องและป้องกันสิทธิและผลประโยชน์ของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน ที่เกี่ยวข้องกับการดำเนินการทางปกครอง กระบวนการยุติธรรมของศาล และรวมถึงการไกล่เกลี่ยประนีประนอมข้อพิพาททั้งปวง
3.4 เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน เช่น มาตราการรักษาความปลอดภัยของบริษัท การบริหารความเสี่ยง การสนับสนุนด้านการนำระบบเทคโนโลยีสารสนเทศ และการนำข้อมูลไปใช้และการบำรุงรักษาระบบด้านเทคโนโลยีสารสนเทศ การตรวจสอบระบบต่าง ๆ เพื่อป้องกันการใช้งานที่ผิดกฎหมาย หรือขัดต่อนโยบายของบริษัทหรือบริษัทที่มีความเกี่ยวข้องกัน การตรวจสอบและป้องกันการคุกคามใด ๆ ที่มิชอบด้วยกฎหมาย
3.5 เป็นการจำเป็นเพื่อสงวน หรือปกป้องสิทธิของบริษัทหรือบริษัทที่เกี่ยวข้องกันภายใต้อำนาจศาล เพื่อตอบรับคำร้องขอด้านการบังคับใช้กฎหมายหรือกระบวนการการเปิดเผยข้อมูล หรือในกรณีที่จำเป็นหรือมีสิทธิกระทำได้ตามกฎหมายที่มีผลบังคับใช้ คำสั่งศาล ระเบียบของราชการ
3.6 เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญา หรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา
3.7 เป็นการปฏิบัติตามบทบัญญัติของกฎหมายที่บังคับต่อบริษัทที่ต้องใช้ข้อมูลส่วนบุคคลของท่าน เช่น กฎหมายภาษีอากร กฎหมายหลักทรัพย์และตลาดหลักทรัพย์ กฎหมายคอมพิวเตอร์ กฎหมายล้มละลาย เป็นต้น และรวมถึงการปฏิบัติตามข้อบังคับ ข้อกำหนดตามกฎหมายหรือของหน่วยงานราชการกำหนดทั้งก่อน ขณะหรือภายหลังจากที่ประกาศฉบับนี้มีผลบังคับใช้
อนึ่ง บริษัท อาจเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลของท่านได้โดยไม่ต้องได้รับความยินยอมจากท่าน ทั้งนี้เท่าที่จำเป็นและตราบเท่าที่เป็นไปตามวัตถุประสงค์และในกรณีดังต่อไปนี้เท่านั้น
(ก) เพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวกับการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุเพื่อประโยชน์สาธารณะ หรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการป้องกันที่เหมาะสมเพื่อคุ้มครองสิทธิและเสรีภาพของท่าน
(ข) เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล
(ค) เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญาหรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญานั้น
(ง) เป็นการจำเป็นเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้มอบให้แก่บริษัท
(จ) เป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่บริษัท เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญน้อยกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของท่าน
(ฉ) เป็นการปฏิบัติตามกฎหมายของบริษัท
ข้อ 4. ข้อมูลส่วนบุคคลของท่านที่บริษัทจะทำการเก็บรวมรวม ได้แก่4.1 ชื่อ – นามสกุล วันเกิด อายุ
4.2 ลายมือชื่อ
4.3 ที่อยู่ตามภูมิลำเนาหรือที่อยู่ปัจจุบัน
4.4 หมายเลขโทรศัพท์
4.5 อีเมล์แอดเดรส
4.6 สำเนาบัตรประจำตัวประชาชน
4.7 สำเนาใบอนุญาตต่าง ๆ ที่ปรากฏข้อมูลส่วนบุคคล
4.8 หมายเลขบัญชีธนาคาร
ข้อ 5. ระยะเวลาในการเก็บรวบรวมข้อมูลส่วนบุคคลบริษัทมีความจำเป็นที่จะต้องเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นในระหว่างที่ท่านยังมีความสัมพันธ์อยู่กับบริษัท หรือตลอดระยะเวลาเท่าที่จำเป็นเพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวข้องกับการให้บริการของบริษัท หรือตลอดระยะเวลาที่บริษัทกับท่านยังมีนิติสัมพันธ์กันตามกฎหมายหรือตามสัญญา และจะเก็บรวบรวมไว้ต่อไปภายหลังจากนั้นเพื่อวัตถุประสงค์ในการพิสูจน์ตรวจสอบกรณีอาจเกิดข้อพิพาทภายในอายุความตามที่กฎหมายกำหนดไว้สูงสุดเป็นระยะเวลาไม่เกิน 10 ปี หากไม่มีข้อพิพาทใด ๆ เกิดขึ้น หรือจนกว่าคดีจะถึงที่สุดและครบกำหนดอายุความในการบังคับคดี กรณีมีข้อพิพาทเกิดขึ้น ทั้งนี้ บริษัทจะลบหรือทำลายข้อมูลส่วนบุคคล หรือทำให้เป็นข้อมูลที่ไม่สามารถระบุถึงตัวตนของท่านได้เมื่อหมดความจำเป็นหรือสิ้นสุดระยะเวลาดังกล่าว
ข้อ 6. ประเภทของบุคคลหรือหน่วยงานซึ่งข้อมูลส่วนบุคคลของท่านอาจจะถูกเปิดเผย ได้แก่6.1 บริษัทที่มีความเกี่ยวข้องกัน บริษัทในเครือ พันธมิตรทางธุรกิจ และ/หรือ บุคคลอื่นใดที่เกี่ยวข้องกับบริษัท รวมถึง กรรมการ ผู้บริหาร พนักงาน ลูกจ้าง ผู้รับจ้าง ตัวแทน ที่ปรึกษาของบริษัท และ/หรือของบุคคลดังกล่าว
6.2 คู่ค้า ตัวแทน องค์กรหรือหน่วยงานภาครัฐหรือรัฐวิสาหกิจที่บริษัทเป็นคู่สัญญา หรือมีนิติสัมพันธ์ (เช่น องค์กรตรวจสอบทั้งภายในและภายนอกบริษัท ผู้สอบบัญชี ธนาคาร เป็นต้น) ซึ่งการเปิดเผยข้อมูลส่วนบุคคลของท่านจะมีวัตถุประสงค์โดยเฉพาะเจาะจง ภายใต้ฐานทางกฎหมายและมาตรการความปลอดภัยที่เหมาะสม
6.3 ตัวแทนทวงถามหนี้ ทนายความ ศาล หน่วยงานภาครัฐ หรือบุคคลใด ๆ ที่บริษัทถูกกำหนดหรือได้รับอนุญาตให้เปิดเผยข้อมูลส่วนบุคคลตามกฎหมาย กฎระเบียบ หรือคำสั่ง
ข้อ 7. สิทธิในข้อมูลส่วนบุคคลของท่าน มีดังนี้7.1 สิทธิในการถอนความยินยอมเสียเมื่อใดก็ได้ เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอมโดยกฎหมายหรือสัญญาที่ให้ประโยชน์แก่ท่าน ทั้งนี้ การถอนความยินยอมดังกล่าวย่อมไม่กระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วโดยชอบก่อนที่จะถอนความยินยอม
7.2 สิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลที่เกี่ยวกับท่านซึ่งอยู่ในความรับผิดชอบของบริษัท หรือขอให้เปิดเผยถึงการได้มาซึ่งข้อมูลส่วนบุคคลที่ท่านไม่ได้ให้ความยินยอม เว้นแต่ ในกรณีที่มีกฎหมายหรือคำสั่งศาลห้ามมิให้กระทำการเช่นนั้น หรือหากการเข้าถึงหรือขอรับสำเนาข้อมูลของท่านจะส่งผลกระทบที่อาจก่อให้เกิดความเสียหายต่อสิทธิและเสรีภาพของบุคคลอื่น
7.3 สิทธิขอรับข้อมูลส่วนบุคคลที่เกี่ยวกับท่านในรูปแบบอัตโนมัติได้ในกรณีที่บริษัทได้เก็บรวบรวมข้อมูลของท่านไว้ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติ และสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ รวมทั้งมีสิทธิ
7.3.1 ขอให้บริษัทส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังบุคคลหรือนิติบุคคลอื่นเมื่อสามารถทำได้ด้วยวิธีการอัตโนมัติ
7.3.2 ขอรับข้อมูลส่วนบุคคลที่บริษัทได้ส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังบุคคลหรือนิติบุคคลอื่นโดยตรง เว้นแต่โดยสภาพทางเทคนิคไม่สามารถทำได้
7.4 สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่เกี่ยวกับท่านเมื่อใดก็ได้ ดังต่อไปนี้
7.4.1 เมื่อมีการเก็บรวบรวมข้อมูลส่วนบุคคลเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้รับมอบให้แก่บริษัท โดยไม่ได้รับความยินยอมจากท่านในการเก็บรวบรวมข้อมูล
7.4.2 เมื่อมีการเก็บรวบรวมข้อมูลส่วนบุคคลเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือของบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่บริษัท โดยไม่ได้รับความยินยอมจากท่านในการเก็บรวบรวมข้อมูล
7.4.3 เมื่อมีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
7.4.4 เมื่อมีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสต์ ประวัติศาสตร์ หรือสถิติ เว้นแต่เป็นการจำเป็นเพื่อการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท
7.5 สิทธิในการขอให้ดำเนินการลบหรือทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ ในกรณีดังต่อไปนี้ 7.5.1 เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล 7.5.2 เมื่อท่านถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่มีอำนาจตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้นได้ต่อไป 7.5.3 เมื่อท่านคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลตามข้อ 7.4
7.6 สิทธิในการขอให้บริษัทดำเนินการให้ข้อมูลส่วนบุคคลของท่านนั้นถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด
7.7 สิทธิในการขอให้ระงับการใช้ข้อมูลส่วนบุคคลได้ ในกรณีดังต่อไปนี้
7.7.1 เมื่ออยู่ในระหว่างการตรวจสอบตามที่ท่านร้องขอให้ดำเนินการตามข้อ 7.6
7.7.2 เมื่อเป็นข้อมูลส่วนบุคคลที่ต้องลบหรือทำลายตามข้อ 7.5 แต่ท่านได้ขอให้ระงับการใช้แทน
7.7.3 เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล แต่เจ้าของข้อมูลส่วนบุคคลมีความจำเป็นต้องขอให้เก็บรักษาไว้เพื่อใช้ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมายหรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย
7.7.4 เมื่อบริษัทอยู่ในระหว่างการพิสูจน์กรณีที่ท่านมีคำขอคัดค้านตามข้อ 7.4 แต่บริษัทได้ปฏิเสธคำคัดค้านของท่านดังกล่าว
7.8 สิทธิในการร้องเรียนในกรณีที่บริษัทหรือผู้ที่เกี่ยวข้องกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล รวมทั้งลูกจ้างหรือผู้รับจ้างของบริษัทหรือของผู้ที่เกี่ยวข้องกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลฝ่าฝืนหรือไม่ปฏิบัติตามพรบ.คุ้มครองข้อมูลส่วนบุคคลหรือประกาศที่ออกตามพรบ.ดังกล่าว หากท่านต้องการใช้สิทธิใด ๆ ที่ระบุในส่วนนี้ ท่านสามารถติดต่อบริษัทได้โดยใช้วิธีการที่อยู่ในส่วน “วิธีการติดต่อบริษัท” คำร้องขอใช้สิทธิใด ๆ ข้างต้นอาจถูกจำกัดโดยกฎหมายที่เกี่ยวข้อง อาจมีบางกรณีที่บริษัทสามารถปฏิเสธคำขอของท่านได้โดยสมควรและโดยชอบ เช่น เมื่อบริษัทต้องปฏิบัติตามกฎหมายหรือคำสั่งศาล หรือที่กฎหมายให้อำนาจที่จะกระทำได้
ข้อ 8. การถอนความยินยอมและผลของการถอนความยินยอมท่านอาจเพิกถอนความยินยอมให้บริษัทเก็บ รวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลดังกล่าวข้างต้น โดยแจ้งให้บริษัททราบและบริษัทอาจขอทราบถึงเหตุผลแห่งการนั้น การเพิกถอนความยินยอมของท่าน จะไม่ส่งผลกระทบต่อการเก็บ รวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล ที่ท่านได้ให้ความยินยอมไปแล้วก่อนหน้านี้ การเพิกถอนความยินยอมให้บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล อาจจะมีผลกระทบกับการรับข้อมูลเกี่ยวกับสินค้าและ/หรือบริการบางส่วนของบริษัท ในบางกรณีบริษัทอาจยังคงเก็บรวบรวมข้อมูลส่วนบุคคลของท่านได้เท่าที่จำเป็นและเท่าที่ได้รับยกเว้นไม่ต้องขอความยินยอมตามกฎหมาย แม้ท่านจะได้ถอนความยินยอมในการเก็บ รวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลแล้วก็ตาม
ข้อ 9. การรักษาความปลอดภัยบริษัทรับทราบและตระหนักถึงความสำคัญของข้อมูลส่วนบุคคลของท่าน บริษัทจะดูแลมาตรฐานการรักษาความปลอดภัยของข้อมูลส่วนบุคคลทั้งด้านกายภาพ เทคนิค และส่วนขององค์กรทั้งหมดตามสมควร รวมถึงการตรวจสอบระบบป้องกันการโจมตีจากภายนอก เพื่อปกป้องข้อมูลส่วนบุคคลของท่านจากการจารกรรม การสูญหาย สูญหายโดยบังเอิญ การแก้ไขเปลี่ยนแปลง การเข้าใช้งานโดยไม่ได้รับอนุญาต การใช้งาน การเปิดเผย การคัดลอก และการทำงานโดยมิชอบด้วยกฎหมาย โดยสอดคล้องกับกฎหมายที่มีผลบังคับใช้ในปัจจุบัน
